Giới thiệu và đơn vị kiểm soát dữ liệu

Chính sách bảo mật này giải thích cách Công ty Cổ phần Csharpp (sau đây gọi là "Csharpp JSC", "chúng tôi") thu thập, sử dụng, lưu trữ và bảo vệ dữ liệu cá nhân của bạn khi bạn truy cập website csharpp.com hoặc liên hệ với chúng tôi qua website.

Với dữ liệu cá nhân phát sinh từ website này, Csharpp JSC là bên quyết định mục đích và phương tiện xử lý dữ liệu (bên kiểm soát dữ liệu). Chúng tôi xử lý dữ liệu cá nhân theo pháp luật Việt Nam, bao gồm Nghị định 13/2023/NĐ-CP về bảo vệ dữ liệu cá nhân, pháp luật về bảo vệ dữ liệu cá nhân và an ninh mạng hiện hành cùng các văn bản hướng dẫn thi hành.

Dữ liệu chúng tôi thu thập

Chúng tôi chỉ thu thập những dữ liệu cần thiết cho các mục đích nêu tại Mục 3:

Dữ liệu bạn chủ động cung cấp qua biểu mẫu liên hệ: họ tên, địa chỉ email, số điện thoại, tên công ty/tổ chức và nội dung tin nhắn. Bạn không bắt buộc phải gửi biểu mẫu để xem website.
Dữ liệu kỹ thuật và nhật ký truy cập: địa chỉ IP, loại trình duyệt, thiết bị, hệ điều hành, trang được yêu cầu, thời điểm truy cập và các thông tin tương tự do máy chủ và hạ tầng mạng ghi nhận tự động nhằm vận hành, bảo vệ và khắc phục sự cố cho website.
Tùy chọn lưu trên trình duyệt (localStorage): website lưu tùy chọn ngôn ngữ và giao diện sáng/tối của bạn (khóa csharpp_lang và csharpp_theme) ngay trên thiết bị của bạn. Các tùy chọn này không chứa thông tin định danh và không được gửi về máy chủ của chúng tôi. Bạn có thể xóa chúng bất kỳ lúc nào trong cài đặt trình duyệt.

Không theo dõi quảng cáo: website không sử dụng cookie theo dõi, cookie quảng cáo hay công cụ phân tích hành vi của bên thứ ba. Nhà cung cấp hạ tầng (Cloudflare) có thể đặt các cookie kỹ thuật thiết yếu phục vụ an ninh và chống truy cập bất thường.

Mục đích xử lý và cơ sở pháp lý

Chúng tôi xử lý dữ liệu cá nhân dựa trên sự đồng ý của bạn, thể hiện khi bạn chủ động gửi biểu mẫu liên hệ hoặc liên hệ trực tiếp với chúng tôi, và trong phạm vi cần thiết để tuân thủ pháp luật hoặc bảo vệ lợi ích hợp pháp của chúng tôi theo quy định. Mục đích xử lý gồm:

tiếp nhận, phản hồi yêu cầu tư vấn, báo giá hoặc hợp tác mà bạn gửi đến;
trao đổi, chuẩn bị đề xuất và, nếu có, ký kết hợp đồng dịch vụ riêng với bạn;
vận hành, bảo mật và cải thiện hiệu năng, độ ổn định của website; phát hiện và ngăn chặn truy cập trái phép hoặc lạm dụng;
ghi nhớ tùy chọn ngôn ngữ và giao diện của bạn;
tuân thủ nghĩa vụ pháp lý và đáp ứng yêu cầu hợp pháp của cơ quan nhà nước có thẩm quyền.

Chúng tôi không sử dụng dữ liệu của bạn cho mục đích khác nếu chưa có sự đồng ý của bạn hoặc căn cứ pháp lý phù hợp. Bạn có thể rút lại sự đồng ý bất kỳ lúc nào theo Mục 8.

Chuyển dữ liệu ra nước ngoài

Do sử dụng hạ tầng toàn cầu của Cloudflare, dữ liệu kỹ thuật và dữ liệu bạn gửi qua website có thể được xử lý tại các trung tâm dữ liệu nằm ngoài lãnh thổ Việt Nam. Khi việc này cấu thành chuyển dữ liệu cá nhân ra nước ngoài theo quy định pháp luật Việt Nam, chúng tôi sẽ thực hiện các nghĩa vụ liên quan (như đánh giá tác động và hồ sơ theo quy định, nếu áp dụng) và yêu cầu bên nhận áp dụng mức bảo vệ phù hợp.

Thời gian lưu trữ

Chúng tôi chỉ lưu dữ liệu trong thời gian cần thiết cho mục đích thu thập hoặc theo yêu cầu của pháp luật:

thông tin liên hệ và nội dung tin nhắn: trong thời gian xử lý yêu cầu và duy trì quan hệ trao đổi với bạn, hoặc cho đến khi bạn yêu cầu xóa;
nhật ký kỹ thuật: trong thời hạn ngắn cần thiết cho mục đích an ninh và vận hành;
tùy chọn trên trình duyệt: lưu trên thiết bị của bạn cho đến khi bạn xóa.

Hết thời hạn cần thiết, dữ liệu sẽ được xóa hoặc ẩn danh hóa, trừ khi pháp luật yêu cầu lưu trữ lâu hơn.

Biện pháp bảo mật

Chúng tôi áp dụng các biện pháp kỹ thuật và tổ chức hợp lý để bảo vệ dữ liệu cá nhân khỏi truy cập, tiết lộ, thay đổi hoặc mất mát trái phép, bao gồm: mã hóa kết nối HTTPS/TLS, các lớp bảo vệ an ninh mạng của hạ tầng Cloudflare, phân quyền truy cập theo nguyên tắc tối thiểu cần thiết và nghĩa vụ bảo mật đối với người được tiếp cận dữ liệu.

Tuy nhiên, không có phương thức truyền tải hoặc lưu trữ nào trên Internet an toàn tuyệt đối. Nếu xảy ra sự cố ảnh hưởng đến dữ liệu cá nhân của bạn, chúng tôi sẽ xử lý và thông báo theo quy định pháp luật.

Quyền của chủ thể dữ liệu và cách thực hiện

Theo quy định pháp luật Việt Nam về bảo vệ dữ liệu cá nhân, bạn có các quyền sau:

Được biết về hoạt động xử lý dữ liệu cá nhân của bạn;
Truy cập, xem và nhận bản sao dữ liệu cá nhân của bạn mà chúng tôi đang lưu giữ;
Chỉnh sửa dữ liệu chưa chính xác hoặc chưa đầy đủ;
Xóa dữ liệu cá nhân hoặc yêu cầu ngừng xử lý trong các trường hợp pháp luật cho phép;
Rút lại sự đồng ý đã cấp, việc rút lại không ảnh hưởng đến tính hợp pháp của xử lý trước đó;
Phản đối hoặc hạn chế việc xử lý dữ liệu của bạn;
Khiếu nại, tố cáo hoặc khởi kiện theo quy định pháp luật, bao gồm khiếu nại với cơ quan nhà nước có thẩm quyền về bảo vệ dữ liệu cá nhân.

Cách thực hiện: vui lòng gửi yêu cầu đến [email protected], nêu rõ họ tên, thông tin liên hệ và quyền bạn muốn thực hiện. Chúng tôi có thể yêu cầu xác minh danh tính để tránh việc dữ liệu bị tiết lộ cho người không có quyền. Chúng tôi sẽ phản hồi trong thời hạn theo quy định pháp luật và nỗ lực xử lý trong vòng 72 giờ kể từ khi nhận được yêu cầu hợp lệ; trường hợp phức tạp, chúng tôi sẽ thông báo cho bạn về thời gian dự kiến.

Trẻ em

Website hướng đến tổ chức, doanh nghiệp và người đã thành niên, không nhằm mục đích thu thập dữ liệu của trẻ em. Chúng tôi không chủ ý thu thập dữ liệu cá nhân của người dưới 16 tuổi. Nếu bạn cho rằng một trẻ em đã gửi dữ liệu cho chúng tôi mà chưa có sự đồng ý của cha mẹ hoặc người giám hộ, vui lòng liên hệ để chúng tôi xóa dữ liệu đó.

Lưu ý về trí tuệ nhân tạo (AI)

Dữ liệu cá nhân và nội dung bạn gửi qua website không được dùng để huấn luyện các mô hình AI công khai. Chúng tôi không đưa thông tin liên hệ hay nội dung trao đổi của bạn vào các mô hình AI công cộng nhằm mục đích huấn luyện.

Thay đổi chính sách

Chúng tôi có thể cập nhật Chính sách này để phản ánh thay đổi trong hoạt động của chúng tôi hoặc quy định pháp luật. Phiên bản mới có hiệu lực từ thời điểm đăng tải trên website, với ngày "Cập nhật lần cuối" ở đầu trang. Chúng tôi khuyến khích bạn xem lại trang này định kỳ.

Introduction and data controller

This Privacy Policy explains how Csharpp Joint Stock Company ("Csharpp JSC", "we", "us") collects, uses, stores and protects your personal data when you visit csharpp.com or contact us through the website.

For personal data arising from this website, Csharpp JSC determines the purposes and means of processing (the data controller). We process personal data in accordance with the laws of Vietnam, including Decree No. 13/2023/ND-CP on personal data protection, the prevailing laws on personal data protection and cybersecurity, and their implementing regulations.

Data we collect

We collect only the data needed for the purposes described in Section 3:

Data you provide through the contact form: your name, email address, phone number, company or organisation name, and your message. You do not have to submit the form to browse the website.
Technical data and access logs: IP address, browser type, device, operating system, requested pages, access time and similar information automatically recorded by our servers and network infrastructure to operate, secure and troubleshoot the website.
Browser preferences (localStorage): the website stores your language and light/dark theme preferences (keys csharpp_lang and csharpp_theme) on your own device. These values contain no identifying information and are not sent to our servers. You can clear them at any time in your browser settings.

No advertising trackers: the website does not use tracking cookies, advertising cookies or third-party behavioural analytics. Our infrastructure provider (Cloudflare) may set strictly necessary technical cookies for security and abuse prevention.

Purposes and legal basis

We process personal data on the basis of your consent, given when you voluntarily submit the contact form or get in touch with us directly, and to the extent necessary to comply with the law or protect our legitimate interests as permitted by regulation. Our purposes are:

to receive and respond to the consultation, quotation or partnership requests you send us;
to communicate with you, prepare proposals and, where applicable, enter into a separate service agreement with you;
to operate, secure and improve the performance and stability of the website, and to detect and prevent unauthorised access or abuse;
to remember your language and theme preferences;
to comply with legal obligations and respond to lawful requests from competent state authorities.

We will not use your data for other purposes without your consent or another appropriate legal basis. You may withdraw your consent at any time as described in Section 8.

International data transfers

Because we use Cloudflare's global infrastructure, technical data and data you submit through the website may be processed in data centres located outside Vietnam. Where this constitutes a cross-border transfer of personal data under Vietnamese law, we will carry out the related obligations (such as impact assessments and filings required by regulation, where applicable) and require recipients to apply an appropriate level of protection.

Retention

We retain data only for as long as needed for the purpose it was collected or as required by law:

contact details and message content: while we handle your request and maintain correspondence with you, or until you ask us to delete them;
technical logs: for the short period necessary for security and operations;
browser preferences: stored on your device until you clear them.

When retention is no longer necessary, data will be deleted or anonymised, unless the law requires longer storage.

Security measures

We apply reasonable technical and organisational measures to protect personal data against unauthorised access, disclosure, alteration or loss, including HTTPS/TLS encrypted connections, the network security layers of Cloudflare's infrastructure, least-privilege access control, and confidentiality obligations for anyone with access to data.

However, no method of transmission or storage over the Internet is completely secure. If an incident affects your personal data, we will respond and give notice as required by law.

Your rights and how to exercise them

Under Vietnamese personal data protection law, you have the following rights:

To be informed about how your personal data is processed;
To access, view and obtain a copy of the personal data we hold about you;
To rectify inaccurate or incomplete data;
To delete your personal data or request that we stop processing it, in cases permitted by law;
To withdraw consent you have given; withdrawal does not affect the lawfulness of processing carried out before it;
To object to or restrict the processing of your data;
To complain, denounce or bring a claim as provided by law, including lodging a complaint with the competent state authority for personal data protection.

How to exercise them: please email [email protected] stating your name, contact details and the right you wish to exercise. We may ask you to verify your identity so that data is not disclosed to anyone without the right to it. We will respond within the period required by law and aim to handle valid requests within 72 hours of receipt; for complex requests, we will tell you the expected timeframe.

Children

The website is intended for organisations, businesses and adults and is not designed to collect data from children. We do not knowingly collect personal data from anyone under 16. If you believe a child has submitted data to us without the consent of a parent or guardian, please contact us so that we can delete it.

Note on artificial intelligence (AI)

Personal data and content you submit through the website are not used to train public AI models. We do not feed your contact details or correspondence into public AI models for training purposes.

Changes to this policy

We may update this Policy to reflect changes in our operations or in the law. The new version takes effect when published on the website, with the "Last updated" date shown at the top of the page. We encourage you to review this page periodically.
